Sex Offenses & Crimes

Sexual Offenses can be located at Chapter 21 of the Texas Penal Code. Such crimes often times carry serious consequences beyond incarceration that can last a lifetime, such as sex offender registration. While sex offender registration was introduced as a tool against sexual predators, the law has evolved to incorporate more offenses, many of which are not considered sexual preditor type offenses.

Common types of Sexual Offenses include sexual deviance with a child, sexual abuse, public lewdness, indecent exposure, indecency with a child, and child pornography.

A common trend of criminal cases has been toward computer online searches where a certain computer is targeted for downloading questionable pornographic materials of young woman, perhaps appearing to be 18, yet in reality, they are 16 or 17 years old. Law Enforcement and prosecutors obtain, through subpoenas, the records of online useage and downloads for a certain IP address and computer, and have to build the case around that infomration, leaving the suspects are anyone with regular access to that computer. Often times the wrong person is targeted and arrested.

Another disturbing trend in sex offense cases is the claim by a spouse -- during divorce proceedings -- that their ex-partner had the habit of downloading and watching child pornography. Some may go as far as to actually download the images on the former family conmputer, only to frame the ex-spouse and be awarded more than their share in the divorce settlement.
