Suspended License Attorney in Austin

Driving While License Suspended is where an individual drives a motor vehicle while knowing that the vehicle registration or driver's license, or both, is currently invalid and suspended. The cycle of tickets and suspensions can be endless; which is why it's important to hire an Attorney.

Often, suspensions stem from Surcharges. Texas is infamous for it's DPS Surcharge Program, which is the #1 cause for suspended licenses in the state. Aside from Surcharges, a person's Texas Driver's License can be suspended for many reasons, from DWI, too many points on their driving record, no insurance tickets, and even drug convictions.

What makes Suspended Licenses illegal?

The Texas Transportation Code 601.371. OPERATION OF MOTOR VEHICLE IN VIOLATION OF SUSPENSION indicates a person commits an offense if during a period that a suspension of the person's vehicle registration is in effect under this chapter, knowingly permits a motor vehicle owned by the person to be operated on a highway.

What are Suspended License Punishments?

An offense under this section is a misdemeanor punishable by: (1) a fine of not less than $100 or more than $500; and (2) confinement in county jail for a term of not less than 72 hours or more than six months. If it is shown on the trial of an offense under this section that the person has previously been convicted of an offense under this section, the offense is punishable as a Class A misdemeanor.
